Motorola Mobility vs. Apple在德勝訴

Motorola Mobility在德國控告Apple侵害其EP0847564號及EP1010336號專利案，德國Mannheim地方法院於2011.11.2.作出判決，認為蘋果有侵權行為，需賠償自2003.4.以來的侵害損失，並頒布禁制令。判決書請見：http://www.scribd.com/doc/71622154/11-11-04-Default-Judgment-for-MMI-Against-Apple
在本案判決後，根據CNET的報導指出，Apple的發言人對本案在公開聲明中表示，這只是一個程序議題，與案件本身無關，因此對於Apple目前在德國銷售產品沒有任何影響。

Smart的看法
本案看起來有點詭異，當初Google大手筆併購了Motorola，而Motorola也不負眾望的對Apple打了勝仗，照理說Android系統應該大樂才是，可是，判決後，根據根據CNET的報導，Apple認為本案對其在德國的銷售沒有影響，這就讓人不解了，Motorola為什麼會花那麼多錢去打一個沒有結果的仗？
對這個問題，經過爬文發現有網站說：Apple在德國的組織架構，是同時有母公司Apple Inc.以及子公司Apple Germany，而這次禁制令的對象，是掛名、沒有實際產品出貨的母公司Apple Inc.，因此不會影響到產品出貨的Apple Germany。
這就妙了，難道Motorola當出提告時不知道他們之間的關係嗎？還是Apple的回應只是為了要穩定軍心？後續效應可能要等到Apple Germany存貨出盡才能知道囉！
